Please read the terms and conditions carefully before paying your deposit.
- Deposit: A non-refundable deposit of 50% of the total fee is to be paid before
commencement of work. If website is to go live within one week, the full balance
is payable and non-refundable.
- Contract: A contract of work will be drawn up which will detail all
work to be carried out by New Moon Web Designs (hereafter known as NMWD). This
must be signed by the client, along with a copy of these terms and conditions
and returned to NMWD before any work can commence. Two concepts will be drawn up according to your
specifications.
- Conceptualising: Conceptualising is the process of producing website
concepts for the client. Included in the cost
of your website (all inclusive website package) are two concepts.
After this, concepts are charged according to work involved (price starts at £50
per concept). This is why we will discuss fully the vision for your website -
colours, layout, style etc., before commencement of design draft.
- Supplying Content: All content - text, images and photographs must be supplied after your draft pages have been presented to you.
Delay in supplying content will result in delay of your website being built. If your contract includes search engine optimisation, NMWD needs the content
to effectively plan this. If content isn't supplied within 3 months of the date of the first draft (unless informed otherwise by the client),
NMWD reserve the right to charge 25% of the balance and gives no guarantee when work shall be finished owing to client's delay.
- Templates: By purchasing a template design, you understand that the layout of your site
may be similar to others purchased by NMWD clients. In some templates colours may be changed.
- Outstanding Balance: The remaining balance is to be paid on completion
of your website. You will be presented with a test view of your website which
you must check that all content is correct, any amendments must be advised as
soon as possible. Your website will "go live"
once payment is received and cleared. Your site will be available on the world wide
web (usually websites appear immediately but can take up to 48 hours) and be submitted to search engines
(if applicable). Failure to pay the remaining
balance will result in your site not being uploaded.
- Payment: Payment is accepted by cheque, bankers draft, bank transfer and by credit card via Paypal. A 4% charge is added to payments made via Paypal.
All payments to be made in British pounds sterling.
- Intellectual Copyright: Graphics, banners, logos, layouts and source codes designed by NMWD will remain the property of NMWD.
Templates designed by NMWD must not be copied or duplicated or passed on to any third party. A fee may be payable to release these to you
should you no longer wish NMWD to maintain your website.
- Client Responsibility with Regard to Copyright: You, the client presents to NMWD an
unconditional guarantee that all elements of text, graphics, photos, designs,
trademarks, or other art work given to NMWD for inclusion in web pages are owned
by you the client, and are not copyrighted to any other party. We
reserve the right to refuse any material of a copyrighted nature unless proof
can be provided that use has been obtained.
- Editing Rights: NMWD reserve the right to edit any text supplied to us for inclusion within your website.
This is usually for search engine optimisation purposes. The client can oppose any changes if they wish.
- Domain Name Registration: Domain names purchased by NMWD on your behalf are registered to NMWD. Domain names to be re-registered
yearly or every two years (depending on type). Failure to re-register domain names will result in the domain name
becoming public property and available for anyone else to purchase. You will be invoiced 8 weeks before the due date.
You may wish to organise your own domain name registration, so that it is registered to you (NMWD can help with this). You will then be responsible for keeping up payments on your domain name and will not be sent a reminder by NMWD. NMWD are not held responsible for domain names becoming available should you not pay your renewal fee in either us purchasing a domain name, or you purchasing a domain name.
- Hosting: To keep your website on the world wide web, the hosting is to be renewed annually, and you will be invoiced
8 weeks before the due date. Failure to pay this will result in your site being removed
from the world wide web. To restore your website to the world wide web after
late payment, an additional charge of £50 is payable on top of the annual
hosting fee. If you have organised hosting yourself, NMWD will need access to your username and password to enable uploading of your website.
- Search Engine Promotion:
If Search Engine Optimisation has been agreed as part of the contract the client must be aware that NMWD are not responsible for
ongoing website promotion. Should the client require the site to be promoted on an ongoing basis a separate contract must be agreed.
NMWD cannot guarantee your position in search engine listings as these are controlled by the search engines, although NMWD optimise your
website to be search engine friendly should you have requested our search engine optimisation services.
- Maintenance & Updates: One years maintenance from the date your website "goes live" is included in the price of
the all inclusive package. You may
also purchase a maintenance package with the template website package. The one years maintenance charge covers additions/changes/removal of text and images only. It
does not include additional pages, website re-design, graphic design or page deletion. These are charged according to work required. If a maintenance package is not purchased and you
require changes to your website, these are charged according to work required.
Price on application.
- Hosting Downtime: Should you choose to arrange your hosting through NMWD, we cannot be held
responsible for any associated loss of potential profits and/or customers, should the server
suffer from any malfunction or downtime.
- Losses: In no event are NMWD liable to you for any loss of business, contracts,
profits or anticipated savings or for any other indirect or consequential or
economic loss whatsoever.
- Price Changes: NMWD reserve the right to amend the price list.
This will not affect you should you have already received a quotation from us.
- Quotations: Quotations are valid for 30 days from date of receipt.
- Cancellation: A cancellation charge of £100 will be payable if you cancel your contract with NMWD prior to the website
"going live". Should NMWD be unable to fulfil the contract, your deposit will be returned to you and you will not be liable to
any other fees.
- Hosting Renewal Cancellation: Should you wish to cease hosting your website
with New Moon Web Designs, 3 months notice is required. If notice isn't
given, a charge of £100 will be payable. Once cancelled any domain names
associated with your website(s) will be available for transfer if applicable
(see 11).
New Moon Web Designs reserves the right to change or modify any of these terms or conditions at any time. You may contact me should you require any clarification on the above terms and conditions.
