These terms and conditions are set to protect you the client and us the designers.  Please read them carefully.

• A contract of work will be drawn up which will detail all work to be carried out by New Moon Web Designs (hereafter known as NMWD).  This has to be signed by the client and returned to us before any work can commence.
  
  
• A non-refundable deposit of 50% of the total cost is to be paid before commencement of work.
  
  
• The remaining 50% to be paid 7 days before the site "goes live". Once payment is received and cleared, your site will be available on the world wide web and be submitted to search engines.  Usually sites will appear immediately but can take up to 48 hours.  Failure to pay the remaining balance will result in your site not being uploaded.
  
  
• All payments to be made in British pounds sterling.
  
  
• Graphics, banners, logos, layouts and codes designed by us will remain the property of NMWD.  Templates designed by NMWD must not be copied or duplicated or passed on to any third party.
  
  
• Should you choose to arrange your hosting through NMWD, we cannot be held responsible for any associated loss of potential profits and/or customers, should the server suffer from any malfunction or downtime.
  
  
• You, the client presents to NMWD an unconditional guarantee that all elements of text, graphics, photos, designs, trademarks, or other art work given to NMWD for inclusion in web pages are owned by you the client, and are not copyrighted to any other party.   We reserve the right to refuse any material of a copyrighted nature unless proof can be provided that use has been obtained.
  
  
• NMWD reserve the right to edit any text supplied to us for inclusion within your website. All amendments must be approved by the client.
  
  
• Domain names and hosting are registered to NMWD. If you wish to take over the domain name and hosting, a transfer fee is payable, after which the domain name and hosting will be released to you, but website design will remain the property of NMWD and cannot be used in future projects by you or a third party.
  
  
• To keep your website on the world wide web, the hosting is to be renewed annually, and you will be invoiced 8 weeks before the due date.  Failure to pay this will result in your site being removed from the world wide web.
  
  
• Domain names to be re-registered yearly or every two years (depending on type).  Failure to re-register domain names will result in the domain name becoming public property and available for anyone else to purchase.  You will be invoiced 8 weeks before the due date.
  
  
• NMWD reserve the right to amend the price list.  This will not affect you should you have already received a quotation from us.
  
  
• In no event are NMWD liable to you for any loss of business, contracts, profits or anticipated savings or for any other indirect or consequential or economic loss whatsoever.
  
  
• NMWD cannot guarantee your position in search engine listings.
  
  
• Quotations are valid for three months.
  
  
• By purchasing a template design, you understand that the layout of your site may be similar to others purchased by NMWD clients.  You understand that colour, text and images can be customised.
  
  
• A cancellation charge of £50 will be payable if you cancel your contract with NMWD prior to the website "going live".  Should NMWD be unable to fulfil the contract, your deposit will be returned to you and you will not be liable to any other fees.
